3. Filing a DMCA Takedown Notice
To be effective under 17 U.S.C. § 512(c)(3), your written takedown notice must include the following six elements:
- Physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material and information reasonably sufficient to permit us to locate the material on the platform (e.g., a direct URL or description of where the content appears).
- Contact information of the complainant, including your name, address, telephone number, and email address.
- A good faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Please send your completed notice to the designated agent listed above. Upon receipt of a valid DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material.
4. Counter-Notification Process
If you believe that material you posted on JMLogMarket was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the Eastern District of Kentucky and that you will accept service of process from the person who provided the original takedown notice (or their agent).
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we will restore the removed material.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, JMLogMarket maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the platform or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Good Faith & Misrepresentation Warning
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before filing a DMCA takedown notice or counter-notification, you may wish to consult an attorney to understand your rights and obligations under the DMCA and other applicable laws.
